Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Aestera (the "Service"), provided by IKUBIX Nathalie Chikhi ("Aestera", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Aestera is software that helps independent artists manage their collection, collectors, outreach, and sales. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own artistic practice or business in accordance with these Terms and the plan you select.

2. Eligibility & account

You must be of legal age to enter a contract in your jurisdiction. If you use the Service on behalf of a business or other entity, you represent that you have authority to bind it. You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it current.

3. Acceptable use

You agree not to:

• use the Service for unlawful, fraudulent, or abusive purposes;
• send spam, phishing, or unsolicited bulk communications;
• infringe intellectual property or privacy rights of others;
• interfere with or compromise the security or integrity of the Service (malware, probing, scanning, scraping, or circumventing technical limits);
• reverse engineer, decompile, resell, or redistribute the Service except where permitted by law.

4. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by IKUBIX Nathalie Chikhi and is protected by intellectual property laws. We reserve all rights not expressly granted. You retain ownership of the content you upload ("Your Content"); you grant us a limited license to host, process, and display Your Content solely to provide the Service.

5. Payments & subscriptions

Purchases are sold directly by IKUBIX Nathalie Chikhi (Aestera). Payments are processed securely by Stripe, our payment service provider. By purchasing a plan, you also agree to Stripe's applicable terms for the payment transaction. Subscriptions renew automatically at the cadence shown at checkout until cancelled. You can cancel at any time from your account or the customer billing portal; access continues until the end of the current billing period. All fees are stated at checkout and are exclusive of any taxes that may apply, which will be added where required.

6. Refunds

Refunds are governed by our Refund Policy.

7. Service availability

We work hard to keep the Service running, but we do not warrant that it will be uninterrupted, error-free, or meet every requirement. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we will make reasonable efforts to allow you to export Your Content for a limited period before deletion.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content, your unlawful or unauthorized use of the Service, or your violation of these Terms.

11. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of France, without regard to its conflict of laws rules. The competent courts of France shall have exclusive jurisdiction over any dispute, subject to any mandatory consumer protection rules of your country of residence.
